Terms and Conditions

1. 1. General

   • 1.1 These terms and conditions here apply to the “Nok Fan Club” membership program, created by Nok Airlines Public Company Limited. When you register to become a member of Nok Fan Club, to receive the member card, to receive the membership number or to receive privileges and benefits from Nok Fan Club, you agree to comply with the following terms and conditions.
   • 1.2 This terms and conditions document is available both in Thai and English language. In case there is a conflict between the two versions, the Thai language version is to be referred to for construe.

2. 2. Membership and Member Card

   • 2.1 Nok Fan Club membership is open to every person (Corporations or other legal entities cannot be enrolled as members). The eligible applicant must meets the conditions, including other specifications on www.nokair.com, and be granted the Nok Fan Club membership by Nok Air. Nok Air reserves the right to accept Nok Fan Club membership.
   • 2.2 The application terms and conditions also include the information filled in the application form. For the reason of security, Nok Air may ask the applicant to give the personal information that can be used in self-verification of the applicant e.g. date of birth or citizen identification number. When the applicant becomes a Nok Fan Club member, the member will be issued Nok Fan Club membership number.
   • 2.3 An applicant must be over the age of 2. The application can be made via the following channels.
   • • (a.) www.nokair.com
     • (b.) Nok Air mobile application.
   • 2.4 A member is eligible to the privileges and benefits after receiving the E-member card.
   • 2.5 The membership and its privileges are applied to the individual member. It is not transferable from a member to another person.
   • 2.6 The member card is a property of Nok Airlines Public Company Limited. The card owner is responsible for safekeeping and returning the card to Nok Air or, in case such an action is requested by Nok Air, the destruction of the card.
   • 2.7 A member may terminate his/her membership at any times by informing Nok Air with a written document, posting to Nok Air head office. Nok Air reserves the right to terminate membership at any times, under any circumstance and without notice. In an event of termination, Nok Air will close down the member account and the member will no longer receive the privileges from Nok Fan Club program, including the refunding of any fee.
   • 2.8 In an event that an announcement is to be made, Nok Air considers a member is informed after Nok Air has contacted the member via text messaging (email, mail, etc.) to the member’s registered address, including email.
   • 2.9 A member may only possess one member account. Nok Air may send information on activities that affect the member account to the member. Please visit www.nokair.com to receive the information.
   • 2.10 A member may change his/her personal information at any times via the website www.nokair.com, or contact Nok Fan Club Call Center 1318 press 8. In case of name or last name changes, member is required to submit the official document to accompany the change request.
   • 2.11 A member agrees to present the member card, membership number, or password to receive any privilege or participate in any Nok Fan Club activity.
   • 2.12 Nok Fan Club member card is not a payment card. In case the information on the card or the membership number is used to receive the privileges without the knowledge of the card holder, the member is considered a liable person. The member is required to notify Nok Air at the first moment possible, via written document to Nok Air head office.
   • 2.13 The membership of Nok Fan Club is a lifetime membership. Membership class can be upgraded when member meets the qualifications of the higher class.
   • 2.14 A member must comply with the following conditions to be eligible for application and becoming a member of Nok Fan Club.
   • • (a.) Provide complete and accurate information to Nok Air
     • (b.) Do not sale, trade or attempt to transfer the Nok Fan Club member’s right to benefits and privileges under no circumstance.
     • (c.) Do not use Nok Fan Club member’s right and privileges in any inappropriate way.
     • (d.) Do not perform any action that is in conflict with Nok Air’s interest or any of Nok Fan Club interested parties under no circumstance.
     • (e.) Follow and verify any change in membership terms and conditions, if there is, via www.nokair.com.
     • (f.) Provide information, when requested by Nok Air, to be used for any privilege confirmation from Nok Fan Club, which may include the information from the flight ticket.

3. 3. Membership Class Upgrade

   • 3.1 Under these terms and conditions, “membership class upgrade” means a Nok Fan Club membership status is upgraded after the member accrued Nok Point at the level specified in each membership class, within a 1 year period (1st January – 31st December). Nok Point must be accrued from traveled flight only; transferred point is not eligible.
   • • (a.) Nok Sky status will be upgraded to Nok Star status when the member accrued 1,500 Nok Point.
     • (b.) Nok Star status will be upgraded to Nok Smile status when the member accrued 1,500 Nok Point.
     • (c.) Nok Smile status will be upgraded to Nok Smile Plus status when the member accrued 15,000 Nok Point. Nok Smile Plus status will start on 1st January of the next year.
   • 3.2 Nok Air may add more conditions for membership upgrading at times. In an event that the added conditions are in conflict with the original conditions, the original conditions will have higher priority and be considered accepted by the member.
   • 3.3 In order to maintain the membership status, a member is required to accrue Nok Point at the level specified in each membership class within a 1 year period (1st January – 31st December). Nok Point must be accrued from traveled flight only; transferred point is not eligible. In case the member fails to meet the conditions above, the membership status will be downgraded to the lower class.

4. 4. Membership Class Downgrade

   • 4.1 Under these terms and conditions, “membership class downgrade” means a Nok Fan Club membership class is downgraded after the member fails to accrue Nok Point at the level specified in each membership class, within a 1 year period (1st January – 31st December).
   • 4.2 Nok Air may add more conditions for membership downgrading at times. In an event that the added conditions are in conflict with the original conditions, the original conditions will have higher priority and be considered accepted by the member.

5. 5. Nok Point

   • Nok Point is earned and collected when a Nok Fan Club member travels with Nok Air under programs specified by Nok Fan Club. The conditions are as follows.
   • 5.1 Nok Point calculation and point accrual conditio
   • • 5.1.1 For each 5 Baht of the ticket price, a member will receive 1 Nok Point (Ticket price excluding Payment Fee, Processing Fee, Call Center Fee, Change Name Fee and any additional fee from Reward flight.)
     • 5.1.2 The calculated Nok Point has to be in whole number. Any fraction from calculation will be rounded down i.e. the airfare of 3,203 Baht, when divided by 5, the member will receive 640 Nok Point.
   • 5.2 Nok Point will be accrual on travelling date and will be valid for 36 months, starting from the date of point receiving until the last day of the month in the following 3 years. For example, a member received 300 Nok Points in April 2018, the points will expire on April 30th, 2021.
   • The expired point is considered invalid and be removed from the member’s account.
   • 5.3 Nok Point will be officially allocated and accrued into the member’s account after Nok Fan Club has passed the application review and approval for membership status.
   • 5.4 Nok Point has to be earned only from flights of Nok Air, or flights being reallocated to other providers due to events beyond Nok Air’s control.
   • 5.5 Only the member with his/her name shown on the flight ticket or the boarding pass will be allowed to earn Nok Point.
   • 5.6 Nok Point program does not have a retroactive effect on the flights prior to becoming a Nok Fan Club member.
   • 5.7 A member travelling with Nok Air will be granted Nok Point for collection only when travelling with the paid ticket.
   • 5.8 Ticket types not allowed for Nok Point accumulation program include.
   • • - Reward Flight from any flight accumulation program
     • - Special tickets for staffs of Nok Air’s shareholder organizations or any prize tickets.
     • - Unused tickets
     • - Expired tickets
     • - Refunded tickets as a result of denied boarding
     • - Tickets received from any business agreement
     • - Ticket reward from any promotional campaigns.
   • 5.9 A member must present Nok Fan Club member card in order to preserve the member’s right to receive the benefits of point collection.
   • 5.10 In an event that a member does not identify the member ID on the day of travel and also unable to verify the membership status, Nok Point will not be awarded at the time. However, the member still have the right to claim Nok Point afterwards by contacting Nok Fan Club Call Center at 1318 press 8. Nok Points will appear in the member’s account 14 days after receiving documents.
   • 5.11 In case of events beyond Nok Air’s control e.g. severe weather conditions that cause the passengers to change their flight schedule or change to another provider, the member may still earn Nok Points based on the original route. In this case a member is required to submit the booking receipts. The member must retain all the document until the point is allocated into the member’s account.
   • 5.12 Nok Air reserves the right to cancellation of some flights on certain routes from participating in the point accumulation system without notice.

6. 6. Privileges and benefits request

   • 6.1 In these terms and conditions, “privileges and benefits request” means an event which a Nok Fan Club member informs Nok Air about the willingness to receive the benefits, privileges or any award, according to the rules specified in www.nokair.com.
   • 6.2 The privileges received are limited in quantity. Nok Air reserves the right to the modification, including holding back and cancellation, and the limitation of benefits and privileges as determined appropriate. Nok Air may changes the benefits and privileges, resulting in some differences from what members have been informed. In this case, Nok Air will consider the value and characteristics of the revised privileges to be near or equal to the original privileges.
   • 6.3 The privileges and benefits request may be made according to what specified in www.nokair.com.
   • 6.4 Nok Air may add more conditions to certain types of privileges and benefits request at times. In an event that the added conditions are in conflict with the original conditions, the original conditions will have higher priority and be considered accepted by the member.
   • 6.5 A member must possess the membership class that is eligible for the requested privileges and benefits at the time of request.

     • *For the trip made during holiday and special occasions, according to the Nok Air’s announcement, member has to redeem point at high fare class and pay an additional 500 Baht fee.

     • (c.) The ticket is not transferable.
     • (d.) The ticket price does not include any fee and tax.
     • (e.) Ticket reward can be redeemed for all product types in the flight, depending on the member’s preference and available Nok Point must be sufficient for the selected seat at the time of booking. In case all normal fare classes are not available, a member is required to redeem the ticket at high fare class.
     • (f.) A member may redeem the ticket reward and select the seat at Nok Fan Club Call Center by calling 1318 press 8.
     • (g.) A member is required to book the flight at least 7 days before departure.
     • (h.) A member may change the flight at least 7 days before the scheduled departure by calling 1318 press 8. For each change, there will be a flight change fee (VAT included). The passenger has to pay for any price difference, if there is. In any case, Nok Air will not refund the price difference in case the ticket is changed to a lower-priced one.
     • (i.) The ticket redeem cannot be cancelled and/or refunded. (Points redemption tickets cannot be requested to accumulate additional points for the purchase of other special services.)

7. 7. Obligation and Duty

   • 7.1 The terms and conditions stated within this agreement are obligation and duty that Nok Air has to the members by guarantee that, while the Nok Fan Club is running, the following services will be provided.
   • • (a.) Accept membership application from customers who are interested, and proceed with the application process.
     • (b.) Provide benefits to members that request.
     • (c.) Distribute Nok Fan Club’s news and information to the email addresses provided by members.
   • 7.2 Nok Air is unable to guarantee that any benefit will be available upon requested. Nok Air reserves the right to limit, withdraw, change, cancel or increase benefits.
   • 7.3 Nok Air reserves the right to change or modify rules, benefits or terms and conditions in the participation of Nok Fan Club activities, in part or in whole, at any times. Nok Air considers it is within the responsibility of the member to acknowledge the most up-to-date information on the benefits, terms and conditions of Nok Fan Club.

8. 8. Personal Benefits and Electronic Message

   • 8.1 The member agrees to the following regulations on personal information, provided to Nok Air for Nok Fan Club program.
   • 8.2 Nok Air may use the personal information the member provided for the following purposes.
   • • (a.) To fulfill the obligations Nok Air has to the member.
     • (b.) To disclose the information to the third party that supports in fulfilling the obligations Nok Air has to the member.
     • (c.) To be used in marketing of products and services.
     • (d.) In attempts to develop and improve customer relations, including product development, research and marketing initiatives, and analysis, and.
     • (e.) To comply with the law and regulations from government or the court’s representatives.
   • 8.3 Nok Air may transfer member’s personal information to and from Thailand to comply with the aforementioned purposes.
   • 8.4 Member’s personal information will be maintained at Nok Air’s head office. The member is responsible for ensuring that the provided information is accurate and complete. Nok Air is permitted to investigate and correct member’s personal information, in accordance with the private right law.

9. 9. Areas of Responsibility

   • 9.1 If any terms and conditions in this agreement are invalid and do not have an obligation, the terms and conditions will not influence the legitimacy, conditions and enforcement of any other terms in this terms and conditions agreement.
   • 9.2 This terms and conditions agreement, including any changes and corrections that involve, is considered a contract regulation for the member of Nok Fan Club program.
   • 9.3 Nok Air is not responsible for any lost, damage or expenditure from Nok Fan Club, indirect or direct, including the denying or agreeing to provide any privilege, even in the case of damage and lost as a result of ignorance or situations under Nok Air’s control.
